China Implements Ambitious Regulatory Framework for Artificial Intelligence
China, aiming to become the global leader in artificial intelligence (AI) by 2030, has recently established several regulations to govern the development and use of AI within its borders. These new rules reflect the Chinese government’s desire to promote innovation in this strategic field while also seeking to control its potential negative impacts.
Key Principles of Chinese Regulation
Among the main focuses of this regulation are:
Promotion of Socialist Values: AI-generated content must align with the ideology of the Chinese Communist Party.
Respect for Intellectual Property: Special attention is given to copyright issues.
Transparency: AI providers must inform users when they are interacting with an AI system.
Prevention of Addiction: Measures must be implemented to prevent users from developing a dependency on AI-generated content.
A Regulatory Framework in Constant Evolution
The Chinese government has adopted a progressive approach, implementing several regulatory texts since 2021:
Regulations on Recommendation Algorithms (2021)
Rules on Generative AI (2022)
Provisional Measures for the Management of Generative AI Services (2023)
These texts impose various obligations on providers and users of AI services, with penalties for non-compliance.
A Different Approach from the European Union
While some principles, such as transparency and respect for intellectual property, are common with the European approach, Chinese regulation is distinguished by:
A greater emphasis on promoting innovation
A more pronounced political control over generated content
A lesser emphasis on the protection of fundamental rights
